Please read these Terms of Service ("Terms") carefully before using Archive ("the Service"). Archive is owned and operated by Trina Tuazon, an individual doing business as Archive ("I", "me", or "my"), located in Los Angeles, California. By accessing or using Archive in any way — including joining our waitlist, creating an account, or browsing our website — you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Archive. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements.
2. Account Registration
To access certain features, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and not share it with third parties
- Accept responsibility for all activity that occurs under your account
- Notify us immediately at hello@archivewishlist.app if you suspect unauthorized access
We reserve the right to disable any account at our sole discretion, including if we believe you have violated these Terms.
3. Acceptable Use
You agree to use Archive only for lawful purposes. You agree not to:
- Violate any applicable local, state, national, or international law or regulation
- Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity
- Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
- Introduce viruses, trojans, worms, or other malicious or harmful code
- Use automated scripts, bots, scrapers, or data-mining tools to access or collect data from the Service
- Interfere with, disable, or disrupt the Service or servers or networks connected to the Service
- Circumvent, disable, or interfere with security-related features of the Service
- Use the Service to send unsolicited communications (spam)
- Engage in any conduct that restricts or inhibits any other user from using or enjoying the Service
4. User Content
You retain full ownership of the content you create, upload, or submit through Archive ("User Content"), including your wishlists, notes, and any other materials. By submitting User Content, you grant Archive a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, reproduce, modify, and display your User Content solely as necessary to provide and improve the Service.
You represent and warrant that: (a) you own or have the rights to all User Content you submit; (b) your User Content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) your User Content complies with these Terms and all applicable laws.
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion and without notice.
5. Intellectual Property
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, icons, and the Archive name — are owned by or licensed to Trina Tuazon and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.
6. Third-Party Links and Services
The Service may contain links to third-party websites, products, or services that Archive does not own or control. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the terms and privacy policies of any third-party sites you visit. Archive is not responsible for any damages or losses caused by your use of third-party services.
7. Digital Millennium Copyright Act (DMCA)
If you believe that content on Archive infringes your copyright, please send a written notice to hello@archivewishlist.app that includes: (a) a description of the copyrighted work; (b) the URL or location of the allegedly infringing content; (c) your contact information; (d) a statement of good faith belief; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner. We will respond to valid DMCA notices in accordance with applicable law.
8. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRINA TUAZON DOES NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (b) ANY ERRORS WILL BE CORRECTED; (c) THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS; OR (d) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRINA TUAZON, DOING BUSINESS AS ARCHIVE, OR HER LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless Trina Tuazon (doing business as Archive) from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any claim that your User Content caused damage to a third party.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, except that either party may bring claims in small claims court if they qualify. BY AGREEING TO THESE TERMS, YOU AND TRINA TUAZON ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.
The arbitration will be administered by JAMS (jamsadr.com) under its Streamlined Arbitration Rules, or if those rules are unavailable, by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration shall be Los Angeles County, California. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for infringement or misuse of intellectual property rights.
12. Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Trina Tuazon each waive any right to a jury trial and agree that the claim will be brought only on an individual basis.
13. Governing Law and Jurisdiction
These Terms and any dispute arising out of or related to them or the Service will be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive personal jurisdiction of the Los Angeles County Superior Court (for state claims) or the United States District Court for the Central District of California (for federal claims), and waive any objection to venue in those courts.
14. Termination
Trina Tuazon may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnity, and limitations of liability — will survive.
You may stop using the Service and request deletion of your account at any time by contacting us at hello@archivewishlist.app.
15. Force Majeure
Trina Tuazon will not be liable for any failure or delay in performance due to causes beyond reasonable control, including acts of God, war, terrorism, riots, natural disasters, government action, power outages, internet disruptions, or failures of third-party service providers.
16. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
17. Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or in-app notice. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the remaining provisions and will not affect the validity and enforceability of the remaining provisions.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trina Tuazon (doing business as Archive) regarding the Service and supersede all prior agreements and understandings. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term.

This Privacy Policy explains how Trina Tuazon, doing business as Archive ("I", "me", or "my"), collects, uses, discloses, and safeguards your information when you use the Archive mobile application and website (collectively, the "Service"), operated from Los Angeles, California. Please read it carefully. By using the Service, you consent to the practices described in this Policy.
1. Information We Collect
Information you provide directly:
- Email address (when joining the waitlist or creating an account)
- Display name, username, and profile photo (optional)
- Wishlist items, notes, product links, and any other content you save
- Communications you send us (support emails, feedback)
Information collected automatically:
- Device information: device type, model, operating system version, unique device identifiers
- Log data: IP address, browser type, pages visited, time spent, referring URLs, crash reports
- Usage data: features used, wishlists created, interactions within the app

Information from third parties:
- If you sign in using a third-party service (e.g., Apple, Google), we receive basic profile information such as name and email address as permitted by that service

Archive is operated from Los Angeles, California, United States. If you are located outside the U.S., your information may be transferred to, stored, and processed in the U.S. or other countries where service providers operate. Where required by law, I ensure appropriate safeguards are in place for such transfers (e.g., Standard Contractual Clauses for transfers from the European Economic Area).

For material changes, we will provide notice via email or a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Policy.
